There are two degrees of statutory sexual assault: one that is a first-degree felony and one that is a second-degree felony.

Statutory sexual assault of the first-degree involves engaging in sexual intercourse with a child under the age of 16, and the accused is 11 or more years older.

Statutory sexual assault of the second-degree is the same in all respects as that of the first-degree, however, the accused is at least four but less than 11 years older than the complainant.

Apart from the direct consequences of being convicted of statutory sexual assault, those convicted are either subject to a 25-year or lifetime registration period as a sex offender on the Megan’s Law registry maintained by the Pennsylvania State Police.
