The crime of terroristic threats is one of the assault crimes where a physical injury is not needed.
A person commits the crime of terroristic threats if the person communicates, either directly or indirectly, a threat to—
- Commit any crime of violence with intent to terrorize another;
- Cause evacuation of a building, place of assembly or facility of public transportation; or
- Other cause serious public inconvenience, or cause terror or serious public inconvenience with reckless disregard of the risk of causing such terror or inconvenience
The crime of terroristic threats punishes “oral threats as well as written threats,” but the crime of terroristic threats is not meant to include “mere spur-of-the-moment threats which result from anger.”
The crime of terroristic threats is generally a first-degree misdemeanor; however, it may be graded as a third-degree felony if an evacuation is caused that diverts “normal or customary operations.”
