HOW IS THIS CRIME DEFINED IN PENNSYLVANIA?
Section 3735.1 of the Vehicle Code requires the prosecution to prove three things before a person can be convicted of aggravated assault by vehicle while DUI:
- Negligently causing another’s serious bodily injury;
- The serious bodily injury is “the result of a violation of Section 3802”—that is, the DUI law; and
- The accused is also convicted of a DUI
HOW SERIOUS IS THIS CRIME?
Aggravated assault by vehicle while DUI is a second-degree felony, punishable up to ten years of imprisonment.
A person who is convicted both of aggravated assault by vehicle while DUI and either (1) Section 1501 (driving without a license), or (2) Section 1543 (driving while operating privilege suspended) may be sentenced up to an additional two years of imprisonment.
